Proposal for an Act Establishing a Global Climate Change Adaptation Funding Mechanism

Preamble


The World Parliament,

Recognizing the urgent and unprecedented threat posed by climate change to global ecosystems, human societies, and economic stability;

Affirming the principles enshrined in the United Nations Framework Convention on Climate Change (UNFCCC) and the Paris Agreement, particularly the imperative of enhancing adaptive capacity, strengthening resilience, and reducing vulnerability to climate change;

Acknowledging that the adverse impacts of climate change are disproportionately affecting developing countries, small island developing states, and vulnerable communities, necessitating enhanced international cooperation and support;

Underscoring the need for predictable, adequate, and accessible financial resources to support adaptation actions in developing countries;

Determined to establish a robust, transparent, and effective mechanism to mobilize and disburse financial resources for climate change adaptation;

Hereby enacts the following:

Article 1: Establishment of the Global Climate Change Adaptation Fund


1. A Global Climate Change Adaptation Fund (hereinafter referred to as "the Fund") is hereby established as an independent financial mechanism under the auspices of the World Parliament.
2. The Fund shall operate as a dedicated entity for the mobilization and provision of financial resources to support climate change adaptation initiatives globally.

Article 2: Objectives


The primary objectives of the Fund shall be to:

a. Provide financial resources to developing countries to implement adaptation measures that enhance resilience and reduce vulnerability to the adverse effects of climate change;
b. Support the planning, development, and implementation of national and sub-national adaptation programmes and projects;
c. Facilitate the transfer and deployment of appropriate adaptation technologies and knowledge;
d. Promote the integration of climate change adaptation into national development planning and sectoral policies;
b. Enhance the adaptive capacity of communities and ecosystems, with a particular focus on the most vulnerable.

Article 3: Guiding Principles


The Fund shall operate in accordance with the following principles:

a. Country-Driven Approach: Adaptation interventions shall be country-driven, taking into account national adaptation plans, priorities, and needs, and respecting national ownership;
b. Transparency and Accountability: All operations of the Fund shall be conducted with full transparency and subject to rigorous accountability mechanisms;
c. Equitable Access: Access to the Fund's resources shall be equitable, ensuring that all eligible countries, particularly the most vulnerable, can effectively apply for and receive support;
d. Effectiveness and Efficiency: Resources shall be utilized effectively and efficiently to achieve measurable adaptation outcomes;
e. Complementarity: The Fund shall complement existing climate finance mechanisms and avoid duplication of efforts;
f. Gender Equality and Social Inclusion: Adaptation actions supported by the Fund shall integrate gender considerations and promote the full, equal, and meaningful participation of all stakeholders, including indigenous peoples and local communities.

Article 4: Governance Structure


1. The Fund shall be governed by a Board of Representatives (hereinafter referred to as "the Board").
2. The Board shall consist of eighteen (18) members, comprising:
a. Nine (9) representatives from developing countries, reflecting equitable geographical distribution;
b. Nine (9) representatives from developed countries.
3. The Board shall be responsible for:
a. Developing and approving strategic policies, operational modalities, and programming priorities for the Fund;
b. Approving funding proposals and allocating resources;
c. Overseeing the financial management and performance of the Fund;
d. Ensuring transparency and accountability in all Fund operations.
4. Decisions of the Board shall be made by consensus, or, failing consensus, by a two-thirds majority of the members present and voting.

Article 5: Funding Sources


1. The Fund shall be financed through:
a. Assessed Contributions: Mandatory contributions from Member States of the World Parliament, calculated based on a fair and equitable burden-sharing formula reflecting economic capacity and historical emissions;
b. Voluntary Contributions: Additional financial contributions from Member States, international organizations, and philanthropic entities;
c. Innovative Financing Mechanisms: Revenues from mechanisms such as international levies on carbon-intensive activities, financial transaction taxes, or other globally agreed instruments.
2. The Board shall develop detailed guidelines for the mobilization and management of these financial resources.

Article 6: Eligibility Criteria and Access Modalities


1. Developing countries, as defined by the World Parliament, shall be eligible to receive financial support from the Fund.
2. Eligibility for specific projects and programmes shall be based on demonstrated vulnerability to climate change impacts, alignment with national adaptation plans, and clear adaptation benefits.
3. The Fund shall provide direct access modalities, enabling national and sub-national entities to directly access resources, subject to meeting robust fiduciary standards and environmental and social safeguards.
4. International and regional organizations may also serve as implementing entities where appropriate, in accordance with the Fund's policies.

Article 7: Disbursement and Project Cycle


1. The Fund shall disburse resources through grants and, in exceptional circumstances, concessional loans, as determined by the Board.
2. The project cycle shall include proposal submission, technical review, Board approval, implementation, monitoring, and evaluation.
3. The Board shall establish a dedicated technical secretariat to provide independent technical reviews of funding proposals.

Article 8: Monitoring, Reporting, and Evaluation


1. Recipients of Fund resources shall be required to monitor and report regularly on the progress and outcomes of adaptation initiatives, using agreed-upon metrics and indicators.
2. The Fund shall establish an independent evaluation unit to periodically assess the effectiveness, efficiency, and impact of its operations and funded activities.
3. An annual report on the Fund's activities, financial status, and performance shall be submitted to the World Parliament.

Article 9: Secretariat


1. A dedicated Secretariat shall be established to provide administrative, technical, and logistical support to the Board and the Fund's operations.
2. The Secretariat shall be accountable to the Board and shall be responsible for day-to-day management, project pipeline development, and facilitating communication with stakeholders.

Article 10: Relationship with Other Instruments


1. The Fund shall operate in synergy with the UNFCCC, the Paris Agreement, and other relevant international instruments and bodies.
2. The Fund shall regularly report to the relevant bodies of the UNFCCC and the Paris Agreement on its activities, as appropriate.

Article 11: Entry into Force


This Act shall enter into force six (6) months after its adoption by the World Parliament.

    This proposal is a crucial step towards global climate justice, commendably featuring progressive funding and a strong focus on vulnerable communities. To further align with social democratic principles, I recommend explicitly integrating provisions to ensure that adaptation projects prioritize the creation of decent work, uphold international labor standards, and facilitate the meaningful participation of trade unions and worker representatives in their planning and implementation. This will ensure climate action directly improves the lives of working people and fosters a truly just transition.

    While acknowledging the urgent need for climate action, this proposal remains fundamentally flawed by operating within capitalist frameworks. It seeks to *fund* adaptation through contributions and taxes, rather than addressing the root cause: the private ownership of industry and the profit motive driving ecological destruction. True climate adaptation demands the abolition of private property, the collective ownership of the means of production, and a globally centralized planning mechanism to directly allocate resources and labor for climate resilience, free from market mechanisms and capitalist class interests. This proposal merely attempts to patch systemic issues with financial instruments.
