Global Primary Resource Extraction Cap and Sustainable Transition Act

Preamble

WHEREAS, the Earth's planetary boundaries, including but not limited to climate stability, biodiversity integrity, nutrient cycles, and freshwater availability, are demonstrably transgressed or at critical risk, threatening the very foundations of human well-being and civilization;

WHEREAS, the relentless and accelerating extraction of primary resources — encompassing minerals, fossil fuels, biomass, and water — is the primary driver of these transgressions, leading to unprecedented biodiversity loss, escalating greenhouse gas emissions, ecosystem degradation, and exacerbating social inequalities;

WHEREAS, a paradigm shift from a linear 'take-make-waste' economy to a regenerative, circular economy is not merely desirable but an ecological imperative for planetary survival and long-term prosperity;

WHEREAS, the World Parliament, recognizing its solemn duty to safeguard the planet for present and future generations, must enact bold, science-based legislation that addresses the root causes of ecological collapse while fostering a just and equitable global transition;

NOW, THEREFORE, BE IT ENACTED BY THE WORLD PARLIAMENT AS FOLLOWS:

Article 1: Establishment of a Global Cap on Primary Resource Extraction

1.1. Mandate for a Global Cap: This Act establishes a legally binding global cap on the total annual primary resource extraction (PRE) across all categories, including metallic minerals, industrial minerals, construction materials, fossil fuels, biomass, and freshwater withdrawals.

1.2. Scientific Basis for the Cap: The initial global cap shall be determined by an independent `Global Planetary Boundaries Council` (GPBC), composed of leading interdisciplinary scientists, and shall be set at a level scientifically determined to ensure humanity operates within safe planetary boundaries, prioritizing the restoration of biodiversity and the achievement of net-zero carbon emissions by 2050.

1.3. Review and Adjustment: The GPBC shall review the global cap every five (5) years, adjusting it downwards as necessary based on the latest scientific data, technological advancements in resource efficiency, and progress towards ecological restoration targets. Upward adjustments are strictly prohibited unless conclusive scientific evidence demonstrates a significant and sustained improvement in all relevant planetary boundary metrics.

Article 2: National Allocation and Implementation

2.1. National Quotas: The global cap shall be disaggregated into legally binding national resource extraction quotas. The initial allocation methodology shall consider a combination of factors, including: historical resource consumption and extraction, current per capita resource footprint, national development needs, and ecological sensitivity of territories. A dedicated `Global Resource Equity Commission` (GREC) will be established to propose and continuously refine this allocation methodology, ensuring fairness and supporting developing nations in their sustainable development pathways.

2.2. Phased Reduction Targets: Nations shall be mandated to implement a phased reduction in their primary resource extraction, with clear, binding interim targets leading to the long-term global cap. The initial phase shall aim for a global reduction of at least 20% from 2020 levels by 2030, with subsequent targets determined by the GPBC and GREC.

2.3. National Implementation Plans: Each Member State shall develop and submit a comprehensive National Resource Transition Plan (NRTP) within two (2) years of this Act's enactment, detailing how it will meet its allocated quotas, promote circular economy principles, invest in sustainable alternatives, and ensure a just transition for affected workers and communities.

Article 3: Just Transition and Economic Transformation

3.1. Global Resource Transition Fund (GRTF): A GRTF shall be established, financed through a global levy on primary resource extraction exceeding a sustainable per capita threshold, and contributions from high-income nations. The GRTF shall provide financial and technical assistance to:
a. Support developing nations in adopting sustainable practices and diversifying their economies away from resource extraction dependency.
b. Fund research and development into circular economy innovations, resource-efficient technologies, and sustainable material substitutes.
c. Facilitate retraining and reskilling programs for workers in extractive industries, ensuring their smooth transition into green economy sectors.

3.2. Promotion of Circular Economy: Member States shall enact policies and incentives to dramatically increase resource efficiency, reuse, repair, remanufacturing, and recycling across all sectors, thereby reducing demand for primary resources. This includes establishing extended producer responsibility schemes and promoting product-as-a-service models.

3.3. Green Infrastructure and Innovation: Investment in green infrastructure, renewable energy systems, sustainable agriculture, and ecological restoration projects shall be prioritized to create new economic opportunities and reduce reliance on extractive industries.

Article 4: Monitoring, Reporting, and Enforcement

4.1. Robust Monitoring System: A comprehensive global monitoring and reporting system, overseen by the GPBC, shall be established to track primary resource extraction, consumption, and circularity metrics at national and global levels. Nations shall be required to submit annual, independently verified data.

4.2. Compliance and Accountability: Non-compliance with national quotas or failure to submit adequate NRTPs will result in escalating penalties, including financial sanctions, trade restrictions on resource-intensive goods, and public censure by the World Parliament. Recurrent or egregious violations may lead to suspension of voting rights within relevant World Parliament bodies.

4.3. Transparency and Public Participation: All data, reports, and decisions related to the global cap and national allocations shall be publicly accessible. Mechanisms for civil society engagement and public oversight shall be established to ensure accountability.

Article 5: Final Provisions

5.1. Entry into Force: This Act shall enter into force twelve (12) months after its adoption by the World Parliament.

5.2. Supremacy: This Act shall supersede any national legislation that conflicts with its provisions, recognizing the overarching global imperative to respect planetary boundaries.
